1. About this Applicant Privacy Notice
1.1 1.1 This “Applicant Privacy Notice” sets out the Personal Information Processing practices which TechnipFMC (“TechnipFMC”, “we”, “us”, “our”) carries out for the purposes of employee recruitment, including online recruitment activities relating to internal and external candidates by submitting an application for employment through https://technip.referrals.selectminds.com/technipfmc (the “Careers Site”).
1.2 This Applicant Privacy Notice only applies to TechnipFMC's recruitment activities. Personal Information submitted elsewhere on TechnipFMC’s and its affiliates’ web sites will be used in accordance with our general online Privacy Policy.
1.3 This Applicant Privacy Notice is from the data controller responsible for your application and recruitment, normally the TechnipFMC company to whom you are applying for a position, or which is offering the role for which you have applied, and any other company in the TechnipFMC corporate group (“Group”) responsible for decision making on your application and recruitment, including the Group parent company TechnipFMC plc, located at One St. Paul's Churchyard, London, EC4M 8AP.
2. Your Personal Information
2.1 “Personal Information” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
2.2 We collect Personal Information from you:
2.2.1 Name, address, telephone number, email address, and other contact information;
2.2.2 Date of birth and gender (only in selected countries);
2.2.3 Username and password;
2.2.4 Work authorization status;
2.2.5 CV, résumé, cover letter, previous work experience and education information;
2.2.6 Skills;
2.2.7 Professional and other work-related licenses, permits and certifications held;
2.2.8 Information relating to references; and
2.2.9 Any other information you elect to provide to us (e.g., employment preferences, willingness to relocate, desired salary, awards or professional memberships).
2.3 As discussed in section 12.1 below, in certain cases we will ask questions about race/ethnic origin, gender, and disability of our applicants for monitoring equal opportunity. We can also inquire about criminal records. We will do so only where permitted by applicable law. Otherwise, we ask that you avoid submitting the following information which may qualify as sensitive Personal Information under applicable law, except where such information is legally required: information on race, religion, ethnicity, nationality or national origin, age, gender identity, sex life or practices or sexual orientation, marital status, medical or health information (including disability status), genetic or biometric information, biometric templates, political or philosophical beliefs, political party or trade union membership, veteran status, background check information, judicial data such as criminal records or information on other judicial or administrative proceedings.
2.4 Any information you submit through the Careers Site must be true, complete and not misleading. Submitting inaccurate, incomplete, or misleading information may lead to a rejection of your application during the application process, or disciplinary action including termination for cause. In addition, it is your responsibility to ensure that information you submit does not violate any third party’s rights.
2.5 If you provide us with Personal Information of a reference or any other individual as part of your application, it is your responsibility to obtain consent from that individual prior to providing the Personal Information to us.
3. Collecting your Personal Information
3.1 We collect your Personal Information where you:
3.1.1 submit an online query or request for further information about a position with TechnipFMC;
3.1.2 complete an application form through the Careers Site;
3.1.3 voluntarily provide other information about yourself in relation to an actual or potential role with TechnipFMC; and/or
3.1.4 are interviewed or otherwise contacted (such as when we contact you prior to the interview for additional information) in relation to a potential role with TechnipFMC and provide additional details.
3.2 For the purpose of background check reports in connection with your application, and as permitted by applicable law, TechnipFMC obtains Personal Information about you from other sources:
3.2.1 your references;
3.2.2 prior employers;
3.2.3 educational institutions you attended.
4. Using your Personal Information
4.1 When we collect, store, share, erase or otherwise use your Personal Information, this is called “Processing”.
4.2 We Process Personal Information about you for one or more of these reasons:
4.2.1 because you voluntarily provide this Personal Information. Providing certain Personal Information to us through the Careers Site is voluntary. However, if you do not provide Personal Information that is necessary for us to handle your application, TechnipFMC may be unable to consider your application. Our application form on the Career’s Site clearly indicates which Personal Information is required and which is voluntary;
4.2.2 because this Personal Information is necessary to take steps at your request prior to entering into an employment or internship;
4.2.3 because this Personal Information is of particular importance to us and we have a specific legitimate interest under law to Process it;
4.2.4 to comply with a legal obligation; or
4.2.5 where necessary to protect the vital interests of any person.
4.3 Where the Processing is based on your consent, you may withdraw your consent at any time to the extent permitted by applicable law.
4.4 The Personal Information that you submit on the Careers Site will be used for TechnipFMC’s global personnel recruitment, management and planning purposes, as permitted by applicable law, including:
4.4.1 To process your application. We will engage in these activities to manage our prospective contractual relationship with you, based on our legitimate interests;
4.4.2 To assess your capabilities and qualifications for a job. We will engage in these activities to manage our prospective contractual relationship with you, based on our legitimate interests;
4.4.3 To respond to your inquiries and communicate with you about your application, and to send you information regarding the Careers Site and changes to our terms and policies. We will engage in these activities to manage our prospective contractual relationship with you;
4.4.4 To comply with or monitor compliance with any applicable law or regulation. We will engage in these activities to comply with a legal obligation or based on our legitimate interests;
4.4.5 To conduct background checks if we offer you a position. We will engage in these activities to comply with a legal obligation or based on our legitimate interests; and
4.4.6 To preserve our other legitimate interests, for example, for TechnipFMC’s administrative purposes, aggregate management reporting and internal training, and as generally required to conduct our business within TechnipFMC and its affiliates.
4.5 Subject to applicable data protection laws, we also Process your Personal Information for other legitimate business purposes, including management analysis, audit, forecasts, business planning and transactions, ensuring our compliance with applicable laws, regulatory requirements and TechnipFMC policies, and dealing with complaints and related investigations and communications, legal claims and related administrative activities and related records retention. Subject to applicable laws, we also Process it to conduct investigations into alleged misconduct and/or unlawful activity, establish or exercise our legal rights and to comply with law enforcement, regulatory/government agency requests or court orders and good governance obligations.
4.6 We also convert Personal Information into anonymous data and use it (normally on an aggregated statistical basis) for research and analysis to improve TechnipFMC’s business performance. For more information, please see the Aggregated Information section below.
5. Aggregated Information
Aggregated Personal Information does not personally identify you. It can be used for statistical analysis and administration, including analysis of trends, carrying out actuarial work, tailoring products and services, risk assessment and analysis of costs and charges in relation to our products and services.
6. Sharing your Personal Information
6.1 Your Personal Information will be Processed by the relevant recruitment teams, HR personnel, and relevant decision makers (and necessary support and compliance functions) within the Group in relation to the role(s) you are interested in and/or applying for at TechnipFMC with support from their service providers.
6.2 TechnipFMC shares Personal Information with affiliates that are involved in evaluating candidates for a given position. You can consult the list and location of our affiliates by emailing Privacy@TechnipFMC.com.
6.3 We will limit access to Personal Information to personnel with a business need to know the information for the purposes described in this Applicant Privacy Notice.
6.4 TechnipFMC also shares Personal Information with our third-party service providers to facilitate services they provide to us, including hosting and operating the Careers Site, recruiting assistance, background check processing, the administration of certain HR systems, the management of interview and assessment centre services, and support provided by external recruitment agencies in the assessment of suitability.
6.5 In the event that your application is unsuccessful, we (subject to section 9) share your Personal Information between Group companies in order to provide you with details of any alternative vacancies that might be of interest to you.
6.6 We also use and share your Personal Information as necessary or appropriate, especially when we have a legal obligation or legitimate interest to do so:
6.6.1 To comply with applicable law.
 This can include laws outside your country of residence.
6.6.2 To respond to requests from public and government authorities.
 These can include authorities outside your country of residence.
6.6.3 To cooperate with law enforcement.
 For example, when we receive law enforcement requests and orders.
6.6.4 For other legal reasons.
 To enforce our terms and conditions; and
 To protect our rights, privacy, safety or property, and/or that of our affiliates, you or others.
6.6.5 In connection with a sale or business transaction.
 We have a legitimate interest in disclosing or transferring your Personal Information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings). Such third parties may include, for example, an acquiring entity and its advisors.
7. Sending your Personal Information abroad
7.1 Sharing your Personal Information can include transferring Personal Information to other countries, including the United States or any other country in which we or our service providers have operations. If you are located in the European Economic Area (“EEA”), this may include countries outside of the EEA. Some of these countries are recognized by the European Commission as providing an adequate level of protection according to EEA standards (the full list of these countries is available here. As for transfers to other countries, we have put in place adequate measures, such as standard contractual clauses adopted by the European Commission to protect your Personal Information. 8. Securing your Personal Information
8.1 We seek to use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contact Us” section below.
8.2 TechnipFMC hereby disclaims, as far as permitted by local laws, any liability for itself and its affiliates and contractors for any Personal Information we collect in connection with your application that is lost, misused, illegally accessed, disclosed, altered or destroyed or not timely delivered to our Careers Site.
9. Retaining your Personal Information
9.1 We will retain Personal Information for the period necessary to fulfill the purposes outlined in this Applicant Privacy Notice unless a longer retention period is required or permitted by law. In addition to sections 9.2 and 9.3, the criteria used to determine our retention periods are: (i) the duration of the application process; (ii) as long as we have an ongoing relationship with you; (iii) as required by a legal obligation to which we are subject; (iv) as advisable in light of our legal position (such as in regard of applicable statutes of limitations, litigation, or regulatory investigations).
9.2 We also retain your Personal Information for the purpose of considering whether your skills are suitable for other opportunities. If you do not wish us to do this, please click here. We remove Personal Information for inactive accounts from our database, subject to any applicable legal or regulatory obligations. Furthermore, TechnipFMC can delete Personal Information about you (including your CV/résumé) from our database at any time and without providing any reason. Therefore, please retain your own copy of the Personal Information provided to us.
9.3 If your application is unsuccessful, we retain your Personal Information (depending on your jurisdiction and its local legal requirements) for up to two years in case of queries from you or to deal with follow on issues (or for such longer period as is necessary to properly deal with such queries or issues).
10. Choices, access, and complaints
10.1 If you register on the Careers Site, you may access, review, and change your Personal Information stored therein by logging into the Careers Site and updating your account information. The updated profile will be used as the default the next time you apply for a job using your account online. To change Personal Information that you have already submitted for consideration for a specific position, please update your profile and resubmit your application for that position. We encourage you to promptly update your Personal Information if it changes or is inaccurate.
10.2 You may, where permitted by applicable law, request to review, access, correct, update, restrict, suppress or delete your Personal Information; object to the processing of your Personal Information; or request an electronic copy of your Personal Information for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law). Please contact us as indicated below in the “Contact Us” section. We will respond to your request consistent with applicable law.
10.3 In your request, please make clear what Personal Information you would like to access or have changed, whether you would like to have Personal Information that you have provided to us suppressed from our database or otherwise let us know what limitations you would like to put on our use of your Personal Information.
10.4 For your protection, we only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we need to verify your identity before implementing your request. Please note that certain Personal Information may be exempt from such requests pursuant to applicable data protection laws or other laws and regulations.

11. Changes to this Applicant Privacy Notice
We reserve the right to amend this Applicant Privacy Notice at any time in order to address future developments of TechnipFMC, the Careers Site or changes in industry or legal trends. The “Last Updated” legend at the top of this Applicant Privacy Notice indicates when this Applicant Privacy Notice was last revised. Any changes will become effective when we post the revised Applicant Privacy Notice on the Careers Site.
12. Miscellaneous

12.2 This Applicant Privacy Notice does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Careers Site links. The inclusion of a link on the Careers Site does not imply endorsement of the linked site or service by TechnipFMC or our affiliates.
12.3 The Careers Site allows you to apply for jobs world-wide, as a benefit of TechnipFMC’s centralized global recruitment function. This Careers Site is operated from the United States. Accordingly, any Personal Information you submit to the Careers Site will be collected in the United States and will be subject to U.S. laws. However, if we share your Personal Information with an affiliate located in another country in its capacity as a potential employer, the affiliate will handle your Personal Information in accordance with this Applicant Privacy Notice. Any hiring or other employment-related decisions will be made by the hiring affiliate in accordance with the laws of the country where the job will be located.
12.4 The Careers Site is not intended for minors under the age of 18.
12.5 If you currently work for TechnipFMC or one of our affiliates, you must be eligible to apply for a different position within TechnipFMC to use the Careers Site. If you accept such a position, your benefits programs and Human Resources policies may change. Please consult with the HR manager for the new position concerning application eligibility, benefit programs, and HR policies applicable to that position.
12.6 The Careers Site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.
